Introduction & Acceptance of Terms

This website is operated by NVSTly, a property of Trade Hub, LLC. Throughout the site and associated services, the terms “we”, “us”, and “our” refer to NVSTly.

By accessing or using NVSTly, including our web and mobile apps, Discord community, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms govern your access to and use of the Service. If you do not agree to these Terms, do not use the Service. NVSTly reserves the right to update, modify, or replace any part of these Terms at any time by posting updates on our website. Your continued use of the Service constitutes acceptance of such changes.

1. Account Registration & Eligibility

1.1 Eligibility

You affirm that you are at least thirteen (13) years of age and possess the legal authority to enter into these Terms. NVSTly does not knowingly collect personal information from individuals under the age of thirteen (13). If NVSTly becomes aware that a user under thirteen (13) has registered for an account, NVSTly shall immediately terminate such account and delete all associated information.

1.2 Account Registration

To access certain features of the Service, you must register for an account. Registration may be completed via third-party OAuth providers including, but not limited to, Google, Discord, X (formerly Twitter), or Apple, or by directly providing an email address. For OAuth registration, your verified email address will be obtained from the OAuth provider; you will only need to create a username and password. For email-only registrations, NVSTly will send a confirmation email to the provided address. Activation of your account requires clicking the confirmation link contained within such email. Failure to confirm your email address may result in suspension or termination of account privileges. Check your spam or junk folder if the confirmation email is not received.

1.3 Username Policy

Usernames must be unique and comply with NVSTly’s community standards. Username changes are not permitted directly by users; any request to change a username must be submitted to NVSTly via email. NVSTly reserves sole discretion to approve, deny, or modify such requests. NVSTly reserves the right to change your account username if it breaks our guidelines.

1.4 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and all activities that occur under your account. NVSTly employs bank-level AES-256 encryption for sensitive data, including passwords, authentication tokens, and session tokens, to protect user information. Despite these measures, you remain responsible for keeping your password secure and enabling Two-Factor Authentication (2FA) to enhance security. You agree to promptly notify NVSTly of any unauthorized use of your account or any breach of security.

1.5 Accuracy of Information

You represent and warrant that all information you provide during registration is accurate, complete, and current. You agree to update your information promptly to maintain its accuracy. NVSTly reserves the right to suspend or terminate accounts that contain false, misleading, or incomplete information.

1.6 Public Nature of Content

All user accounts, trades, dashboards, and social posts on NVSTly are publicly visible by default. NVSTly does not currently offer private accounts or private trade submissions.

NVSTly is developing features that allow users to set a delay for when trades are made public to their followers, the trades feed, and dashboards. Users who do not set a delay will have their trades visible in real-time. Trades posted with a delay will not trigger notifications to followers, as delayed notifications would not reflect current trading activity.

By using the Service, you acknowledge and accept that any information you share may be publicly accessible to other users and that certain features may allow you to control the timing of when trade information is made public.

2. User Content & Conduct

2.1 User-Generated Content

NVSTly allows users to post content, including but not limited to trade ideas, comments, analyses, messages, and other materials ("User Content"). You retain all rights to your User Content; however, by submitting or posting User Content on or through NVSTly, you grant NVSTly a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media or platform now known or hereafter developed, without compensation or attribution to you.

2.2 Public Visibility of User Content

All User Content submitted on NVSTly is public and accessible by all users by default. NVSTly does not currently provide functionality to restrict access or make User Content private.

In the future, NVSTly may offer features that allow select top or vetted traders to monetize their content. Under such features, real-time trade notifications, analyses, and other User Content may be restricted to followers who subscribe to that trader. Monetized traders may still choose to post occasional real-time trades, analyses, social posts, or comments that remain publicly visible.

By posting User Content, you acknowledge and accept that your submissions will be visible according to these settings and accessible to other users and third parties unless restricted through a paid subscription or other feature provided by NVSTly.

2.3 User Conduct

When using NVSTly, you agree to abide by all applicable laws and regulations, and to refrain from posting User Content or engaging in activities that:

(a) are unlawful, fraudulent, or deceptive; (b) infringe upon the rights of NVSTly or any third party, including but not limited to intellectual property rights; (c) contain defamatory, libelous, obscene, offensive, harassing, threatening, or discriminatory material; (d) promote violence, hate speech, or discrimination based on race, ethnicity, gender, sexual orientation, religion, age, disability, or any other protected characteristic; (e) engage in spam, phishing, or any unsolicited promotional activities; (f) impersonate any person or entity or misrepresent your affiliation with any person or entity; (g) participate in or promote manipulative trading activity, including but not limited to “pump and dump” schemes, “rug pulls,” or any other fraudulent trading practices; or (h) violate NVSTly’s community guidelines or any other applicable terms or policies.

NVSTly reserves the right to investigate suspicious or manipulative trading behavior and may take appropriate enforcement action against accounts found to be engaging in such activities. Users acknowledge that the community may identify and report questionable conduct, and that such reports may be subject to public disclosure as part of NVSTly's commitment to maintaining platform integrity and protecting users from fraudulent practices.

2.4 Moderation and Enforcement

NVSTly reserves the right, but does not undertake the obligation, to monitor, review, remove, or restrict any User Content or user activity that it reasonably believes violates these Terms or is otherwise objectionable, inappropriate, or harmful. NVSTly may suspend or terminate accounts or restrict access for violations without prior notice.

2.5 Reporting Violations

Users may report content or behavior that they believe violates these Terms through NVSTly's designated reporting channels. Reports can be submitted via our Contact Page, by emailing [email protected], or through the NVSTly Discord server using the NVSTly Support bot- this provides the quickest response. NVSTly will investigate and take appropriate action at its sole discretion.

3. Community Guidelines

NVSTly fosters a positive, respectful, and secure environment across all our platforms. This includes the NVSTly web/mobile app as well as our official Discord community. To maintain a productive and safe experience for all users, we require compliance with the following guidelines:

3.1 Respectful Communication

All users must interact respectfully with others, avoiding any form of harassment, discrimination, hate speech, or abusive language. Bullying, personal attacks, or derogatory comments based on race, ethnicity, gender, sexual orientation, religion, age, disability, or other protected characteristics are strictly prohibited.

3.2 Scam Prevention and Security Awareness

Users must not engage in or facilitate scams, phishing, impersonations, or other malicious activities. Our Discord community has dedicated resources and moderators actively monitoring for suspicious behavior. Users are encouraged to report any potential scams immediately. For guidance, please refer to our Scam Defense and Prevention Blog.

3.3 Appropriate Content and Behavior

• No sharing of illegal, explicit, or otherwise inappropriate content.
• Avoid spamming, flooding, or repetitive messaging that disrupts conversations.
• Do not share private information or solicit such from others.
• Follow channel/topic-specific rules and use designated channels properly, especially within Discord.

3.4 Roles and Responsibilities in Discord

Discord community roles (e.g., moderators, admins, special contributors) help maintain order and enforce guidelines. Users must respect their authority and decisions. Attempts to circumvent moderation or abuse roles may result in a mute, quarantine, or at worse a temporary or permanent removal.

3.5 Privacy and Confidentiality

Respect the privacy of fellow users. Do not share personal contact details, sensitive information, or trade secrets without consent. NVSTly does not endorse sharing proprietary brokerage or financial account details publicly.

3.6 Reporting and Enforcement

Users are encouraged to report violations using official channels. NVSTly reserves the right to take appropriate actions, including content removal, warnings, suspensions, or permanent bans from the platform or Discord server, to protect the community and platform integrity.

3.7 Community Spirit

We encourage collaborative and supportive interactions. Share knowledge, insights, and constructive feedback to help everyone grow as traders and investors.

4. Prohibited Uses

In addition to other rules outlined in these Terms, you may not use NVSTly or its content to:

(a) engage in any unlawful activity;
(b) solicit others to perform or participate in unlawful acts;
(c) violate any international, federal, state, or local laws or regulations;
(d) infringe upon the intellectual property rights of NVSTly or others;
(e) harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on protected characteristics, including but not limited to race, ethnicity, gender, sexual orientation, religion, age, or disability;
(f) submit false, misleading, or deceptive information;
(g) engage in spam, phishing, or any unsolicited commercial communications;
(h) interfere with or circumvent the security features of the Service or any related website;
(i) engage in market manipulation, including but not limited to pump-and-dump schemes, rug pulls, or any activity intended to artificially influence the price or perception of securities or other financial instruments;
(j) violate NVSTly’s Community Guidelines or any other applicable terms, policies, or rules established by NVSTly.

NVSTly reserves the right, at its sole discretion, to investigate and take action against users who violate these prohibited uses. Such actions may include, but are not limited to, removal of content, temporary suspension, or permanent termination of accounts. Users found to engage in manipulative or abusive trading practices may also be publicly disclosed to the community by NVSTly to maintain platform integrity and protect other users.

5. Scams and Fraud Disclaimer

NVSTly strives to maintain a safe and secure community; however, we are not responsible for any losses, damages, or other consequences resulting from scams, fraud, or malicious activity conducted by other users.

Users are strongly discouraged from communicating, trading, or sending funds to other users outside of the NVSTly platform or official Discord community. This includes, but is not limited to, copy trading arrangements, investment solicitations, or requests for funds to be managed by another user. NVSTly does not monitor or control off-platform interactions and cannot guarantee the safety or legitimacy of such arrangements.

We provide educational resources, including our Scam Defense and Prevention Guidelines, to help users recognize and protect themselves from potential scams. Users are encouraged to report suspicious activity, posts, or messages using our official reporting channels to assist in community moderation.

By using NVSTly, you acknowledge and agree that any scam, fraud, or unauthorized activity conducted off-platform is your sole responsibility. NVSTly expressly disclaims any liability arising from interactions, trades, or communications that occur outside of the Service.

6. Financial & Investment Content Disclaimer

6.1 No Financial, Investment, Legal, or Tax Advice

All content, materials, communications, and information provided by NVSTly, including trade ideas, market analysis, performance data, user-generated content, chat messages, and educational materials, are for informational and educational purposes only. NVSTly does not provide financial, investment, legal, tax, or any other professional advice. Nothing on the platform, including testimonials or performance histories, should be construed as a recommendation to buy, sell, hold, or otherwise transact in any security, financial instrument, or investment strategy.

6.2 Risk Acknowledgment

Trading and investing involve substantial risk of loss and are not suitable for every investor. Past performance is not indicative of future results. Users acknowledge and agree that all trading decisions made by users are their sole responsibility. NVSTly expressly disclaims any liability arising from any investment decisions or actions taken based on information on or through the platform.

6.3 Independent Advice

Users are encouraged to seek independent advice from a qualified financial advisor, legal counsel, or tax professional before making any investment or trading decisions. NVSTly makes no warranties or guarantees regarding the accuracy, completeness, or timeliness of any content or information.

6.4 AI-Generated and Beta Features

Certain features of NVSTly may include AI-generated content, trading signals, or beta tools, which are experimental in nature. Such content and features are provided "as is" without any guarantee of accuracy, completeness, or performance. Users acknowledge the inherent risks and uncertainties associated with AI-generated insights and beta tools, and agree that NVSTly is not responsible for any losses or damages resulting from reliance on these tools.

If users encounter any issues, errors, problems, glitches, or discrepancies related to these features, NVSTly encourages reporting such occurrences through our designated Discord support channels (e.g., [email protected] or the official Discord support bot). NVSTly may, at its sole discretion, adjust, correct, update, or remove trades or related content to maintain the integrity of the platform. Our team exercises reasonable judgment when making these adjustments. Users found attempting to manipulate, exploit, or abuse these systems may face temporary suspension, removal of affected trades, or other corrective actions as deemed appropriate by NVSTly.

6.5 No Reliance

By using NVSTly, you agree that you will not rely on any information provided on the platform as the sole basis for making any investment or trading decisions.

7. Modifications to the Service and Prices

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service.

8. Third Party Links

Certain content, products, and services available via our Service may include materials from third-parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with NVSTly. We are not responsible for examining or evaluating the content or accuracy, and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

9. Referrals & Payouts

9.1 Eligibility & Account Status

Accounts deleted with any referral rewards will lose the entire balance permanently; it cannot be restored or paid out. Accounts suspected of abusing, manipulating, or "gaming" the referral system will lose the entire balance and may be removed from the platform. NVSTly reserves the right to remove rewards or wipe a reward balance if there is rightful cause.

Existing PRO Members who haven't linked a referral code to their accounts cannot enter a referral code in their Membership Settings. To credit rewards to a referrer, an invitee must sign up using a referral link or enter a referral code in their Membership Settings before becoming a PRO Member.

9.2 Reward Pending Period

Rewards have a 60-day pending period during which they cannot be paid out. Rewards are issued immediately after an invitee completes a billing period payment. If an invitee disputes a charge during the 60-day pending period, the reward will be removed from your balance. Even if the dispute is resolved in NVSTly’s favor, the rewards will not be credited back.

9.3 Payout Requirements

A minimum reward balance of $5.00 is required for payout eligibility. Payouts may take up to 30 days to be fulfilled after a payout request is initiated. All payout requests will be manually reviewed. NVSTly reserves the right to deny a payout if the referral system is suspected of being abused.

9.4 Payout Methods & Fees

Payouts will incur payment fees when PayPal or cryptocurrency is chosen, and these fees will be deducted from the payout amount. CashApp has zero fees unless it implements fees in the future. All payouts are issued in USD. PayPal may convert this to your native currency, and cryptocurrency payouts will use the current USD market value at the time of fulfillment.

10. Broker Integration & Account Linking

NVSTly offers optional functionality to link brokerage accounts (e.g., Webull, Moomoo, Charles Schwab) to enhance the user experience by enabling automatic tracking and sharing of trades through the NVSTly platform. By connecting your brokerage account to NVSTly, you acknowledge and agree to the following terms:

10.1 Read-Only Access

NVSTly operates with read-only access. We do not have the ability to:

• Place, modify, or cancel orders
• Execute trades
• Initiate deposits or withdrawals from your account

Integration is solely intended to read your account’s trade and order history to automatically populate and share trading activity within NVSTly.

10.2 Broker Affiliation

NVSTly may have certain partnerships or referral arrangements with select brokers, such as Moomoo or Webull. However, availability of integration with any broker does not constitute an endorsement, guarantee, or official support by the broker, unless explicitly stated. NVSTly is not affiliated with brokers with whom no formal partnership exists, such as Charles Schwab.

10.3 Responsibility, Risks & Open Beta

• Not all brokers officially support third-party integration; linking your account may be against your broker’s terms of service. You are solely responsible for ensuring that linking your account complies with your broker’s terms and applicable laws.
• Brokerage integration may be in open beta depending on the broker. Trades may be missed, delayed, or not tracked correctly. NVSTly can only resolve issues when users report errors, discrepancies, or other problems. Users are expected to participate in reporting feedback to support.
• Webull integration has completed open beta testing, but occasional issues may still arise. Newly added brokers undergo minimal internal testing, and NVSTly relies on our userbase to identify unanticipated issues.
• Broker integrations may stop working at any time due to internal changes to broker APIs (e.g., authentication updates). Repairs may take time, and NVSTly is not obligated to continue offering any specific integration if it becomes unfeasible.

10.4 User Control & Reauthentication

• You may unlink or disconnect your brokerage account at any time via the Brokers & Exchanges section in User Settings.
• Users are responsible for monitoring their broker connections and reauthenticating when required. NVSTly currently does not provide automated notifications for expiring broker connections, but plans to add push, email, & Discord DM notifications in the near future. Please periodically check the Brokers & Exchanges section to monitor expiration and reauthentication requirements.

10.5 Data Handling & Security

• NVSTly applies bank-level encryption and security protocols to all sensitive data, including session tokens, API keys, and broker integration sessions.
• NVSTly does not collect or store brokerage login credentials (email, password). If a broker PIN is required, it is encrypted using AES-256 standards.
• Accessed and stored data is limited to trade and order information, and basic account identifiers required for syncing.

11. Disclaimer of Warranties; Limitation of Liability

NVSTly cannot deposit, withdraw, or execute trades on your behalf. Future features, such as 1-click copy trading, may introduce new functionality, which will have additional terms and user obligations.

To the fullest extent permitted by law, we do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free. You agree that from time to time, we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind.

In no case shall NVSTly, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

12. Feedback & Issue Reporting

• Users encountering any issues, errors, or glitches are encouraged to report them through designated support channels (e.g., [email protected] or the official Discord support bot).
• NVSTly may, at its discretion, correct, adjust, or remove trades to maintain platform integrity. Users found manipulating or exploiting the system may face suspension or reversal/removal of affected trades

13. General Conditions

We reserve the right to refuse service to anyone for any reason at any time.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

14. Optional Tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

15. Errors, Inaccuracies, and Omissions

Occasionally, there may be information on our site or in the Service that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, availability, or other information. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information if any information in the Service or on any related website is inaccurate at any time without prior notice.

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

16. Personal Information

Your submission and storage of personal information through our website is governed by our Privacy Policy.

17. Refund Policy

By using NVSTly and/or purchasing products from us, you agree to our Refund Policy.

18. Indemnification

You agree to indemnify, defend, and hold harmless NVSTly and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

19. Severability

If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

20. Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

21. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

22. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of California, United States.

23. Changes to Terms of Service

You can review the most current version of the Terms of Service at any time on this page.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Refund Policy

Cancellation & No Refund Policy

You may cancel your subscription at any time. When you cancel your subscription, your membership will remain in effect to the date of expiration. To cancel your membership, go to the Membership section of your account settings and hit the Manage Membership button to cancel or update your subscription. For detailed instructions please refer to our Help Center.

Note: You must cancel your subscription before the next billing period to avoid being charged for the next billing period fee.

NO REFUNDS

Refunds will NOT be issued for any current subscription AND no credit, refunds, or prorated billing will be provided for subscriptions that are canceled mid-month. To prevent being charged on the next billing period, cancel the membership subscription. Upon cancellation, your membership will remain in effect until the end of the billing cycle. We provide a comprehensive 7-day trial completely free of charge, with no obligation or requirement for billing information. We believe this empowers potential subscribers to fully experience our service and make an informed decision about subscribing.
